In case of Road Traffic Accident

 
 

1. Send the injured to the nearest Hospital
2. Mark the SOC, remove the vehicles involved and ensure free flow of traffic
3. Note down the registration number(s) of the vehicles involved / date / time and place of occurrence
4. Involved vehicles may be detained and handed over to the investigation team

Immediately after getting information regarding the accident, rush to the accident spot . If the injured are still at the spot, first aid to be given and be sent to the nearest Hospital for treatment.
Get the complaint, register a case,investigate, arrest the accused and produce the vehicles concerned before the Motor Vehicle Inspector for MV test .

After completion of  investigation, the Investigation Officer shallsubmit final report before the Honourable jurisdictional court forfurther trial

In simple accident cases, if the parties involved are agreed for a compromise, they have to make a written statement of compromise before the jurisdiction Investigation Officer.

Copy of the rough sketch of the Scene of Occurrence

Copy of the Accident Register (AR Copy)
Copies of the faulty vehicle's Record
[ Driving Licence,Registration Certificate, Insurance Certificate and Motor Vehicle Inspector's report. ]
Copy of the Inquest report
Copy of the Postmortem Certificate.
Copy of the Wound Certificate

The Investigation Officer shall inform the victim/injured/legal heir regarding the availability of  FREE LEGAL AID service at High Court campus, Chennai 104

[In all fatal / non-fatal accident cases, police shall send FIR, rough sketch, Inquest report and  Post Mortem certificate to the Free Legal Aid. The same documents also be sent to the Collector through Deputy Commissioner of Police (Traffic) for Honourable Chief Minister's Relief Fund. 

Free legal Aid Board is helping the victim or their legal heir to file motor accident claims petition before the Motor Accident Claims Tribunal to get due compensation.

In case of unknown fault vehicle, a solatium of Rs. 25,000/- in fatal accident   and Rs.12,500 in grievous injury through Free Legal Aid Board.
It is to be claimed with in a year from the date of occurrence by the injured/legal heir of the deceased.

Relief under section 140 or 163A Motor Vehicles Act 1988
Under these sections of  law, the legal heir(s) of the deceased and persons who suffered permanent disablement are legally entitled for compensation of Rs.50,000/- in case of fatal, Rs.25,000/- in case of permanent disablement irrespective of the fault of either the deceased/injured.  The compensation may be claimed either from the owner of the vehicle concerned or the authroised insurer of the vehicle(s) involved.
 

The Collector will disburse the cheque through the Tahsildhar of respective Taluk Office to the Victim/injured/ legal heir.
For Fatal accident   - Rs.10000/-
For Simple injury     - Rs.500/-
For Grievous injury  - Rs. 500/-
For the permanent single disability Rs. 4000/-

For permanent multi disability Rs. 6000/-

1. Copy of  the FIR
2. Copy of the rough sketch 
3. Copy of the Wound Certificate / post mortem certificate
4. Copy of the inquest
5. Copy of  the Hospital summary , Bills  
6. Copy of  the faulty vehicle's Insurance certificate 
7. Copy of  the driving license of the fault vehicle's driver
8. Copy of  the faulty Vehicle's RC Book
9. Copy of the residential proof
10.Copy of the legal heir certificate
11.Copy of Age proof of victim/injured and legal heir  

For Identified Bodies:
After the completion the Postmortem, the body to be handed over to the relative of the victim.
For Un-Identified Bodies:
The body  to be kept in the Govt. Hospital Mortuary to trace out the identity.
The photograph of the body with available details to be published through Press, Weekly Crime and Occurrence Sheet and Tamilnadu Criminal Intelligence Gazette to verify with the details of the Missing persons.
Take the finger prints of the un-identified body to trace out the identity with finger print bureau.

Even in case of delay in lodging complaint pertaining to road accident, it may be given to the local jurisdictional traffic investigation officer or superior officers.
